Terms of Use

Read the full terms governing the use of WISTECH products, services, and platform content.

These Terms of Service ("Terms") govern your access to and use of WISTECH products, services, and website (collectively, "Services"). By engaging WISTECH for any service, you acknowledge and agree to these Terms.

1. Services Overview

WISTECH provides software development, AI and automation solutions, business systems, API integration, cloud infrastructure, product strategy, consulting, training, graphic design, social media management, and related digital services. Detailed scope for each engagement is outlined in a project proposal or contract.

2. Website Design Services

Payment Terms: A 60% deposit is required before work commences. Once initial designs are approved, the remaining 40% is due. The final 40% balance must be settled before publishing the completed website to the designated domain.

Project Scope: Scope, timeline, and deliverables are outlined in the project proposal. Scope changes must be agreed upon in writing and may incur additional charges.

Revisions: Clients may review and request revisions within the agreed scope. Additional revisions outside scope may result in additional fees.

Ownership: Upon final payment, clients own the rights to the design work created by WISTECH.

3. Software Development Services

Payment Terms: A 60% deposit is required before project commencement. The remaining 40% is due upon completion and handover.

Scope of Work: Project scope, features, and timeline are detailed in the proposal or contract. Post-commencement scope adjustments may incur additional charges.

Testing and Quality Assurance: Clients are responsible for reviewing software during testing. Post-approval changes are treated as new requests and charged accordingly.

Maintenance: Post-development support is not included unless specified in the contract. Maintenance can be purchased as an add-on service.

4. Consulting Services

Consultation fees are agreed upon in advance and must be paid in full before the engagement begins. All consulting services follow a written agreement outlining deliverables, timelines, and expectations. Clients must provide necessary information and documentation for effective service delivery.

5. Training Services

Clients must pay 70% of the training fee upfront to secure registration. The remaining 30% is due before issuing the certificate of completion. Rescheduling requires at least 72 hours notice. Cancellations made less than 5 days before the start date result in forfeiture of the deposit.

6. Graphic Design Services

A 60% deposit is required before starting, with the remaining 40% payable before final files are delivered. Clients are entitled to two free rounds of revisions. Design file ownership transfers upon final payment.

7. Social Media Management

Payments are made monthly in advance. Clients review and approve content before posting. WISTECH provides monthly performance reports but does not guarantee specific results. Social media accounts remain the property of the client.

8. Hosting and Domain Services

Domain Renewal: Domains renew on their purchase date. A late renewal penalty of 35% applies if payment is delayed by more than 21 days after expiration.

Hosting Renewal: Hosting renews annually on or before January 1st. Non-payment within 21 days may result in website redirection or removal. Annual renewal includes hosting, maintenance, backups, security patches, and technical support.

9. Payment Terms

All payments must be made by the due date specified in the invoice. A late payment fee of 5% of the total invoice applies to payments delayed by more than 10 days. WISTECH reserves the right to suspend services until payment is made for overdue accounts.

10. Intellectual Property

WISTECH reserves the right to include a prominent "Powered by WISTECH" link in the footer of website designs. Clients may remove this link for a one-time fee of $150 USD. WISTECH retains the right to use completed work for promotional purposes unless otherwise agreed in writing.

11. Confidentiality

WISTECH treats all client information as confidential and will not disclose it to third parties without explicit written consent, unless required by law.

12. Website Access and Responsibilities

Clients are typically granted Editor-level access to their CMS websites, allowing content management while preventing unintended modifications to critical settings. Administrator access may be granted on a case-by-case basis to clients with technical expertise. Clients with administrator access are solely responsible for any modifications made. Restoration of functionality due to client modifications may incur fees.

13. Cancellation and Refund Policy

Cancellation of any project or service must be requested in writing. Payments made prior to cancellation are non-refundable unless otherwise agreed in writing.

14. Limitation of Liability

WISTECH liability for any claim, damages, or losses arising from its services is limited to the amount paid by the client for the specific service or project. WISTECH is not liable for delays or failures caused by circumstances beyond our control, including but not limited to acts of God, natural disasters, pandemics, labor strikes, internet outages, or government actions.

15. Third-Party Services

WISTECH may engage third-party vendors for project components. We are not liable for delays, damages, or issues caused by third-party providers.

16. Data Protection

WISTECH follows industry-standard practices to ensure data security. However, we cannot guarantee absolute protection against cyberattacks or data breaches.

17. Compliance with Laws

Both WISTECH and the client agree to comply with all applicable laws, regulations, and industry standards during the engagement.

18. Amendments

WISTECH reserves the right to update these Terms at any time. Clients will be notified of significant changes via email or other appropriate communication channels.

19. Dispute Resolution

Disputes arising from the agreement will be resolved through arbitration in the jurisdiction where WISTECH is located. The arbitration process will be conducted in English. If arbitration is unsuccessful, disputes may be referred to the courts within the jurisdiction of WISTECH operations.

20. Acceptance of Terms

By engaging WISTECH for any service, you acknowledge and agree to these Terms. Engagement through signing a contract, making a deposit, or accepting a proposal constitutes acceptance of these Terms in full.
